New York Attorney General Issues Price Gouging Warning Ahead Of Winter Storm

Letitia James issued a consumer alert warning residents and businesses about price gouging as another winter storm approaches New York.

Kathy Hochul has declared a state of emergency across the state ahead of the expected storm.

The alert reminds businesses that New York law bars charging excessive prices for essential goods and services during market disruptions or declared emergencies. The law applies to vendors, retailers, and suppliers operating in the state.

“Winter weather is no excuse for price gouging,” James said. “As New Yorkers prepare for another snowstorm, my office is on the lookout for those trying to take advantage of consumers with excessive price hikes. I encourage everyone to be vigilant and report examples of price gouging in their community to my office.”

New York’s price gouging statute prohibits businesses from selling goods or services vital to health, safety, or welfare at what the law defines as an “unconscionably excessive price” during an emergency.

Covered items include food, water, gasoline, generators, batteries, flashlights, hotel lodging, and transportation options. The restrictions apply when abnormal disruptions in the market affect the availability of these goods and services.

Violations can carry civil penalties of up to $25,000 per violation.

The Office of the Attorney General is urging consumers who encounter sharp price increases to file a complaint.

Consumers reporting suspected price gouging should:

  • Document the specific increased prices.
  • Note the dates and locations where the higher prices were observed.
  • Provide copies of sales receipts.
  • Submit photos of advertised prices, if available.

The attorney general’s office reviews complaints and may investigate businesses that appear to violate the law.

With a state of emergency in effect, officials are urging residents to prepare for winter conditions and to report suspected misconduct tied to storm-related demand.
