Actor Jamie Foxx denies allegations of sexual assault leveled against him in a lawsuit filed by an anonymous woman under New York’s Adult Survivors Act, citing the incident as occurring in August 2015.

A representative for the 55-year-old actor addressed the allegations on Thursday, firmly stating to PEOPLE, “The alleged incident never happened.” The spokesperson highlighted a prior lawsuit, sharing, “In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter. The claims are no more viable today than they were then. We are confident they will be dismissed again.”

Emphasizing Foxx’s stance, the spokesperson added, “And once they are, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”

The lawsuit against Foxx was lodged in New York Supreme Court on Wednesday. According to documents obtained by PEOPLE, the accuser, referred to as Jane Doe, detailed the alleged incident as occurring at Catch NYC.

Foxx, known for his versatile performances in various films and television shows, has consistently refuted the allegations and remains resolute in contesting the claims in the legal realm.
