One year after the accidental drowning death of actor Malcolm-Jamal Warner, his widow has filed lawsuits against his mother, alleging that the late star’s estate owes her more than $1.2 million under the terms of their premarital agreement.
Tenisha Warner filed actions in California and Georgia on Monday, the first anniversary of Warner’s death, naming Pamela Warner, the trustee of the Warner Family Trust, as the defendant. The lawsuits contend that Malcolm-Jamal Warner agreed in a 2022 premarital agreement to provide financial benefits that were never fulfilled before his death.
According to court filings, Tenisha Warner alleges her late husband agreed to maintain a $1 million life insurance policy naming her as the sole beneficiary. She also claims she is owed more than $50,000 in anniversary payments, $30,500 in Roth IRA contributions, and $195,000 in unpaid salary for serving as Warner’s chief of staff.
The lawsuits argue that Warner’s estate lacks sufficient assets to satisfy those obligations and seek payment from the Warner Family Trust, which is administered by Pamela Warner. Tenisha Warner is also seeking interest, attorney fees, and court orders related to trust distributions while the litigation proceeds.
In a public statement reported by multiple outlets, Tenisha Warner said she pursued legal action only after concluding it was necessary to protect her and the couple’s young daughter before legal deadlines expired. She said she is now the family’s sole provider and described the lawsuits as a last resort.
The filings also allege that Malcolm-Jamal Warner intended to update his estate plan to reflect his marriage and daughter but died before completing those changes. The Warner Family Trust was established in 1996, years before his marriage.
Pamela Warner has not publicly responded to the lawsuits. However, on the anniversary of her son’s death, she shared a social media message reflecting on a year marked by grief, loss, and personal growth.
Malcolm-Jamal Warner, best known for portraying Theodore “Theo” Huxtable on “The Cosby Show,” died on July 20, 2025, at age 54 after accidentally drowning while swimming in Costa Rica. Authorities determined he was caught in a strong ocean current.
